Laboratories of Conscience: Conscience Courts as a Trans-Confessional and Trans-cultural Phenomenon in the Russian Empire 1775–1866

Die Slavonic Bibliothek in Helsinki und das Max Weber Netzwerk Osteuropa laden Sie zum Vortrag von Frau Prof. Dr. Katja Makhotina, Universität of Erlangen-Nürnberg, herzlich ein. Anschließend wird es eine Möglichkeit geben, über die Geschichte des Gewissensdiskurses und der Gewissensgerichte auszutauschen.

Abstract:

Law vs. conscience – what leads to justice? Why did conscience begin to play a role in russian legal practice alongside positive law – and what is the history of this concept? A cultural history of Russian conscience has not yet been written and the presentation will discuss some new research approaches.

Conscience appears in sources of different genres and has, in addition to the legal-praxeological dimension, a strong social dimension. On one hand, the research project is oriented towards the discourse history of conscience: legal literature, public magazines, moral writings and Belles-lettres from the early 19th century provide an insight into the use of the new language and semantics when it comes to the goals of penal practice. On the other hand, the project inquires into the social practice of “judging by conscience” and presents field studies from the practice of conscience courts (sovestnye study). The conscience court in Viipuri/Vyborg will be one of my case studies.

The research project has greatly benefited from the extensive collection of the Slavonic Library and the lecture will present the results of the bibliographical research.
